This intel brief is meant to take a deep dive into the Biden Administration gun policies and how it will affect our constitutional rights to keep and bear arms. During this brief I will be using President-Elect Biden’s Gun Policies taken straight from his campaign website.

In this Intel drop we will look into the Biden Administration’s weapons ban, mandatory buyback proposal, and restricting firearm purchases.
First, let’s dive into the Biden Administration’s Weapons Ban and how it will shape his agenda moving forward.
Biden Administration Weapons Ban
The Biden Administration has a lot of potential legislation in place that will restrict your rights when it comes down to firearms. The cornerstone to his Administration’s plan is to reinstate the weapons ban of ‘94.
Let’s look at his objective to reinstate the ‘94 weapons ban. What that ban would entail and what weapons it would look to restrict.
Ban the manufacture and sale of assault weapons and high-capacity magazines.
Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun. That means our federal law does more to protect ducks than children. It’s wrong. Joe Biden will enact legislation to once again ban assault weapons. This time, the bans will be designed based on lessons learned from the 1994 bans. For example, the ban on assault weapons will be designed to prevent manufacturers from circumventing the law by making minor changes that don’t limit the weapon’s lethality. While working to pass this legislation, Biden will also use his executive authority to ban the importation of assault weapons.
Let’s that look at the history of the history of the 1994 weapons ban and how it effected the firearms industry and community.
‘94 weapons ban

During his time as a Senator Biden was one of the primary authors to the Violent Crime Control and Law Enforcement Act of 1994. Also, know as the ‘94 weapons ban. This ban prohibited the manufacture of certain civilian semi-automatic firearms referenced as assault weapons.
The main firearm the ‘94 ban targeted was the AR-15 platform. The AR-15 platform had been classified as an assault weapon by the ‘94 ban. That ban restricted the sale of modern day sporting rifle to civilians, also known at the AR-15. This ban also restricted magazines that were identified as having “large capacities”.
The ‘94 ban was in effect for 10 years unless renewed by congressional vote aka a sunset clause. In 2004, it wasn’t renewed and the ban was lifted.
Regulation of existing AR-15s by the National Firearms Act(NFA)
The effects of Biden administration’s reinstatement of the weapons ban will come with a major caveat. The addition and reclassification of the AR-15 under the NFA.

Regulate possession of existing assault weapons under the National Firearms Act.
Currently, the National Firearms Act requires individuals possessing machine-guns, silencers, and short-barreled rifles to undergo a background check and register those weapons with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Due to these requirements, such weapons are rarely used in crimes. As president, Biden will pursue legislation to regulate possession of existing assault weapons under the National Firearms Act.
Registration of the AR-15 platform
This additional language to the new weapons ban will reclassify the AR platform as a item to be regulated by the ATF under National Firearms Act. Meaning that you will have to register your firearm with the ATF and pay a $200 tax stamp for having your AR-15 you have legally purchased.
This registration has the potential to possibility add more than just the AR platform. It could encompass all semi-automatic pistols and shotguns. That inclusion means those firearms would be regulated by ATF under the NFA.
What does all this mean?
How does the potential new ban effect us? The new Administration seeks to reinstate that ban with a major caveat. Under a Biden Administration he would be reinstating the ‘94 ban in its totality and would seek language to put all semi-automatic weapons on the list to be regulated by the NFA. That would mean your semiautomatic pistols, rifles, or shotguns would be restricted under this bill. Effectively, limiting the firearms you could buy and purchase as a citizen. While also potentially crippling the firearms industry.
This legislation would be in direct violation of your 2nd Amendment rights. This ban has a cascading effect over other policies the new administration wishes to enact. The reinstatement and addition to this proposed ban would be severely detrimental to the firearms industry and firearms community, as a whole.
This legislation will have a negative impact on the industry financially. While stifling Americans right to keep and bear arms. This policy has a cascading effect that works in concert with his other gun control measures.
Next, let’s look into his administration proposed mandatory government buy back program.
Biden administration mandatory buy back program
One of the cascading effects of the Biden Administration gun policies is the mandatory buy back program. This program would require you to sell back your firearm to the federal government for less than you bought it for.
Let’s investigate the excerpt on Biden’s Mandatory Buy back Program.
Buy back the assault weapons and high-capacity magazines already in our communities.
Biden will also institute a program to buy back weapons of war currently on our streets. This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act.
Increasing the price of gun ownership
The Biden Administration has giving gun owners two options. Register your firearm or sell them back to the government. If you refrain from selling your firearms back or registering them you put yourself at risk of being outside the law. This move is an obvious attempt to undermine your constitutional freedom to keep and bear arms.
First, let’s look at firearm registration. Under this initiative, you would have to register your firearm with the ATF under the NFA. To register you would have to file a Form 1 aka register your firearm. With that registration comes a $200 tax stamp per item. So, if you had 4 AR’s that would cost you $800 to register them besides the magazines you will have to register also. Remember all “large capacity” magazines will fall into that category. Adding more to your tab to register those firearms. Essentially, making firearm ownership astronomical to deter current owners and potential new gun owners.
Second, you can sell back your firearm to the federal government. The federal government will not give you back what you paid for the firearms. They will strip you of your firearms and give you back pennies on the dollar. Leaving you with no way to defend yourself or your family while taking a lost on a financial investment.
What these actions by his future administration is making the price of firearm ownership astronomical to stop Americans from buying firearms. While also drastically limiting the number of firearms a person can buy within a year because of price. They are telling you have to sell your weapons back to federal government at pennies on the dollar. This potential new registration doesn’t affect the wealthy just middle Americans who want to exercise their rights to keep and bear arms. This plan has effect of telling average Americans only the wealthy are allowed to exercise the second amendment rights.
Gun confiscation and your rights
What this initiative also allows is for the Biden Administration to build a gun registry so it can move to disarm us all. The only reason the government seeks to register your firearms is so they can take them from you by force or intimidation. The gun registration is not about safety but governmental power and control.
The firearm registration has one goal to strip the rights of the people to defend themselves and to solidify the government’s increasing power.
Lastly, let’s investigate Biden Administration on the stockpiling of weapons. Below, is the excerpt from his campaign on this specific policy.
Reducing the stockpiling of weapons
In order to reduce the stockpiling of firearms, Biden supports legislation restricting the number of firearms an individual may purchase per month to one.
Reducing your ability to buy firearms
The legislation this administration supports is an obvious infringement of your second amendment rights. He plans on enacting law telling you how many firearms you can buy in a month. You have the ability and right to use your constitutional right as you see fit.
Again, this is an attempt to deter potential new gun owners by discouraging gun ownership. While telling current owners you can only use your rights to a certain extent. Both, options are biased against gun owners while being unconstitutional.
All, these moves by this Administration is to suppress and stifle the firearms industry and suffocate people’s ability to use their constitutional freedoms. Freedoms granted to them by the founders of this great nation.
Conclusion
When it comes down to the Biden Administration’s gun policies it’s clear. They are designed to restrict, stifle, and suffocate the second amendment rights of free Americans.
First, he will seek legislation to reinstate the ‘94 weapons ban with a major caveat: force registration of your AR-15. Also, the potential registration of all semi-automatic pistols, shotguns, and large capacity magazines.
Second, his administration seeks to impose a mandatory buyback. 1. You register your firearms with the ATF under the NFA. 2. You sell your firearms back to the federal government. Their objective is to create a registry for a potential gun confiscation by the federal government. These actions effect Americans as a whole. It is an obvious ploy to disarm the citizenry and impose their will upon a newly unarmed population.
Third, the proposed legislation seeks to impose a mandatory one gun a month purchase. This will block your ability to use a constitutional right that has been granted to you. The government seeks to tell you how often you can exercise your freedoms. It is an overt attack on our freedoms and liberties. We must stand stall and defend those rights.
